To use Orchestra, you must create an account. You agree to provide accurate, current, and complete information during the registration process. It is your responsibility to keep your account information updated.
You are solely responsible for maintaining the confidentiality of your account credentials. You agree not to disclose your credentials to any third party. You are responsible for all activities that occur under your account.
2. User Conduct
You agree to use Orchestra for lawful purposes and in compliance with these Terms. You shall not engage in any conduct that may interfere with or disrupt the functionality of Orchestra or compromise its security.
You agree not to:
- Use Orchestra to transmit, distribute, or store any material that is unlawful, defamatory, infringing, obscene, or harmful to others.
- Attempt to gain unauthorized access to any part of Orchestra, other user accounts, or any related systems or networks.
- Use any automated means or scripts to access or interact with Orchestra, unless expressly authorized by us.
3. Intellectual Property
Orchestra and its content, including but not limited to software, text, graphics, logos, and images, are protected by intellectual property rights. You may not modify, reproduce, distribute, or create derivative works based on Orchestra without our prior written consent.
By using Orchestra, you do not acquire any ownership rights to the intellectual property of Orchestra or any third-party materials displayed on Orchestra.
4. Privacy
We collect, store, and process your personal information in accordance with our Privacy Policy. By using Orchestra, you consent to the collection, use, and disclosure of your personal information as described in the Privacy Policy.
5. Payments and Billing
Certain features or services provided by Orchestra may require payment. You agree to pay all applicable fees and charges associated with the use of such features or services.
Payments are processed through our trusted third-party payment processor. We do not store your payment information directly. Please refer to the applicable payment processor's terms and privacy policy for more information.
6. Limitation of Liability
To the maximum extent permitted by applicable law, we shall not be liable for any direct, indirect, incidental, consequential, or exemplary damages arising out of or in connection with your use of Orchestra.
7. Modifications to the Service
We reserve the right to modify, suspend, or discontinue Orchestra, or any part thereof, at any time and without prior notice. We shall not be liable to you or any third party for any such modifications, suspension, or discontinuation.
8. Termination
We may terminate or suspend your access to Orchestra, without prior notice or liability, for any reason, including but not limited to a breach of these Terms.
Upon termination, your right to access and use Orchestra will immediately cease. All provisions of these Terms that by their nature should survive termination shall survive termination, including but not limited to ownership provisions, warranty disclaimers, indemnity, and limitations of liability.
9. Governing Law and Jurisdiction
These Terms shall be governed by and construed in accordance with the laws of United Kingdom. Any dispute arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of United Kingdom.
10. Severability
If any provision of these Terms is held to be invalid, illegal, or unenforceable under any applicable law, such provision shall be deemed severed from these Terms, and the remaining provisions shall remain in full force and effect.
11. Entire Agreement
These Terms constitute the entire agreement between you and Productized, Inc. regarding your use of Orchestra and supersede all prior and contemporaneous agreements, representations, and understandings.
